Connecticut Law and Fathers’ Rights

Connecticut isn’t a “mother state.” Under CGS § 46b-56, the Superior Court must consider the best interests of the child in all custody and visitation orders, and the statute expressly requires courts to provide children with the active and consistent involvement of both parents. Fathers and mothers hold equal rights under Connecticut law.

The best-interests factors courts weigh include the physical and emotional safety of the child, each parent’s capacity to understand and meet the child’s needs, the existing relationship between the child and each parent, and each parent’s willingness to support the child’s relationship with the other parent. A noncustodial father also retains the right to access his child’s academic, medical, and hospital records under CGS § 46b-56(g) unless a court orders otherwise.

Do I Need to Establish Paternity Before Seeking Custody?

If you weren’t married to the mother at the time of the child’s birth and no Acknowledgment of Parentage was signed, you must establish paternity before filing a custody petition. We can walk you through the steps involved.

Can a Mother Deny Visitation?

No. A father may have the right to visitation even when the mother holds sole custody, depending on the court’s orders. Denial of court-ordered visitation can be addressed through a motion for contempt in the Superior Court.

Can a Father Seek Child Support?

Yes. A father who is the primary custodian has the same right to seek child support as any other custodial parent. The child support guidelines apply regardless of the parents’ genders.

What If Circumstances Change After a Custody Order?

Either parent may petition the court to modify custody or support when there has been a material change in circumstances. Job changes, relocation, and shifts in the child’s needs are common grounds.
